Abstract
La elección del tema obedece, en primer lugar, a que se trata de una reciente incorporación a nuestro Ordenamiento Jurídico (no deja de ser novedoso para nosotros, aunque en muchas legislaciones del mundo, la regulación de esta figura o de otras similares, data de muchos años) y en segundo término, por su vinculación con una problemática de marcada actualidad, como lo es la "Ancianidad", en virtud de que la figura a examen es aplicable también a esta etapa de la vida. Y en la búsqueda de los institutos que hoy se encuentran regulados en los distintos ordenamientos jurídicos, y los que no están regulados y debieran estar, la Declaración anticipada de voluntad aparece como uno de los posibles, que amerita su análisis.
