LAS COOPERATIVAS DE TRABAJO ASOCIADO: INTERROGANTES Y RESPUESTAS DESDE EL DERECHO DEL TRABAJO

Resumen El artículo tiene el propósito de presentar el perfil social de las cooperativas desde un enfoque jurídico, y destacar los peculiares rasgos que esta forma de organización de la empresa exhibe frente a las sociedades mercantiles con las que, frecuentemente, suelen ser confundidas. En tal sentido, se parte de su naturaleza para poder entender todo el entramado jurídico, económico y social del ente cooperativo, en particular, de las cooperativas de trabajo asociado, como modalidad que caracteriza al cooperati­vismo en Cuba, con énfasis en el carácter del vínculo que se establece entre la cooperativa y sus miembros, y entre la primera y la fuerza de trabajo que ella contrata, con el objetivo de dar respuesta a varias interrogantes que, de manera recurrente, afloran con relación a la naturaleza jurídica de este sujeto económico y, como derivación de esta, a la distribución de competencia en sede judicial para dirimir los diferentes conflictos que, en el contexto del cooperativismo cubano actual, emergen con un comportamiento ascendente, como consecuencia del nuevo escenario económico de la sociedad. Abstract The article aims to present the social profile of cooperatives from a legal approach, and highlight the peculiar features that this form of organization of the company exhibits against the commercial companies with which, often, are often confused. In this sense, it is based on its nature to be able to understand the whole juridical, economic and social framework of the cooperative entity, in particular, of the associated work cooperatives, as a modality that characterizes cooperativism in Cuba, with an emphasis on the nature of the link that is established between the cooperative and its members, and between the first and the work force that it contracts, with the aim of responding to several questions that recurrently arise in relation to the legal nature of the cooperative. this economic subject and, as a derivation of it, the distribution of jurisdiction in the courts to settle the different conflicts that, in the context of current Cuban cooperativism, emerge with an ascending behavior, as a consequence of the new economic scenario of society.
